Marijuana and Employment: Alaska has legalized both medical and recreational cannabis. However, employers may establish and apply drug-free workplace policies that address the use, consumption, possession, transfer, or sale of marijuana in the workplace, as well as policies related to off-duty marijuana use where permitted by applicable law. Employers are also not required to accommodate medical marijuana use in the workplace. But employers should exercise caution when implementing drug testing policies, as the state has established specific requirements including, but not limited to, policy requirements, notification that pre-employment drug testing is required, and reasons for testing.
