● Ban the Box: While Delaware does not have a statewide Ban the Box or Fair Chance law that applies to private employers, public employers generally may not include questions about criminal history on job applications. Instead, public employers should typically delay asking about criminal history until the first interview. Although this applies to public employers, many private employers have also adopted this as a best practice.
● Marijuana and Employment: Delaware permits recreational and medical marijuana, but employers may prohibit marijuana use in the workplace and take appropriate action if an employee uses marijuana at work or is impaired during working hours. However, employers generally may not make an adverse hiring or employment decision, or otherwise penalize, a person, based on their status as a medical marijuana cardholder; or aqualifying patient’s positive marijuana drug test result, unless workplace use, possession, or impairment is involved. A positive test alone may not necessarily indicate impairment for registered medical marijuana patients.
● Fair Credit Reporting Act (FCRA): Delaware employers should provide proper disclosures and obtain written authorization before obtaining a background check from a screening provider. The federal FCRA also requires employers to follow a pre-adverse and adverse action process if they plan not to hire or to rescind an offer based, or partly based, on information in the background check.
